Release and Waiver of Liability - Mini Golf Madness

In consideration of being allowed to participate in the activities and use the equipment provided by Mini Golf Madness, I, the undersigned, acknowledge, appreciate, and agree to the following:

Assumption of Risk: I understand that participation in mini golf involves inherent risks, including but not limited to, the risk of flying golf balls, slips, trips, falls, and other accidents that may result in injury. I assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in mini golf at Mini Golf Madness .
Safety and Conduct: I agree to adhere to all safety guidelines and rules provided by Mini Golf Madness, including but not limited to:
- Being aware of flying golf balls and exercising caution.
- Not hitting the golf ball too hard to avoid injuring others, or self.
- Following all posted signs and instructions from staff.
- Behaving responsibly and not engaging in vandalism or misuse of the space or equipment.
Equipment Use: I understand that all equipment provided by Mini Golf Madness is to be used responsibly and only for its intended purpose. I agree to return all equipment in the same condition it was provided to me. I acknowledge that I may be held financially responsible for any damage to equipment or property caused by my misuse or negligent behaviour.
Medical Emergencies: In the event of a medical emergency, I authorize Mini Golf Madness staff to provide first aid and seek emergency medical treatment if necessary. I understand that I am responsible for any medical costs incurred. I acknowledge that Mini Golf Madness does not provide health or accident insurance for participants and that I am encouraged to have my own medical coverage.
Photography/Video Release: I grant Mini Golf Madness permission to use photographs and videos taken during my participation for promotional purposes, including social media, websites, and marketing materials.
Release of Liability: I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Mini Golf Madness, its owners, employees, and agents from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or loss I may suffer, or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
Arbitration of Disputes; Time limit to Bring Claim: I understand that by agreeing to arbitrate any dispute as set forth in this section, I am waiving my right, and the right(s) of the minor child(ren) above, to maintain a lawsuit against Mini Golf Madness LLC for any and all claims covered by this Agreement. By agreeing to arbitrate, I understand that I will not have the right to have my claim determined by a jury, and the minor child(ren) above will not have the right to have claim(s) determined by a jury. Any claim or dispute must be brought within one (1) year from the date of the incident giving rise to the claim and be determined by arbitration county of Bengaluru Karnataka, regardless of any statute of limitations or other law to the contrary. Failure to bring a claim within this time period will result in the claim being forever barred. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. This Agreement shall be governed by, construed and interpreted in accordance with the laws of the India, without regard to choice of law principles. Notwithstanding the provision with respect to the applicable substantive law, any arbitration conducted pursuant to the terms of this Agreement shall be governed by Arbitration and Conciliation Act.1991.

I acknowledge that I have read this release of liability and waiver form, fully understand its terms, and agree to it freely and voluntarily without any inducement.

Parent/Guardian Agreement (if participant is under 18): I am the parent/guardian of the participant and agree to the terms and conditions outlined in this waiver and release of liability form on their behalf.
